OK, so what happened to the driver who filed the false police report? What happened to the detective who passed on the offer of a quiet interview? What happened to the commanding officer who orchestrated the SWAT raid (knowing that SWATing has killed innocent people)?

What needs to be investigated by the Texas State
Attorney General’s Office is: How did resources become dedicated to nabbing this “dangerous felon”
and who made that call? Law enforcement officials
still need to proceed with caution and disbelief of the
cause of complaint. They didn’t vet the plaintiff.

I agree completely. Law Shield should at least be able to refer victims of negligent police work to attorneys who know how to seek damages from those responsible for the miscarriage of justice.

Wow. I used to be a Houston policeman – patrol, then child abuse, then forgery detail (Burglary and Theft Division). While it’s not entirely out of the norm to get a To Be filed and make an arrest before an indictment, it’s more than a little odd they did it this way given the circumstances. No other witnesses, and no physical evidence = “I wouldn’t even have investigated the case at all.”
Frankly, given the circumstances, I’m stunned that they could find a magistrate who signed off on this lunacy, that the magistrate believed the affiant was in the right on this. This really just blows my mind.
The first line of a probable cause statement start “Officer so-and-so, hereafter your affiant, has reason to believe, and does believe…”
“Your affiant” had zero REASON (as in “the faculty of reason/logic”) to believe, without physical evidence and without any disinterested 3rd party witnesses, that any such crime had occurred.
You were dealing with an incompetent cop.
Scary stuff. I would like to read more about this case. Are there any news articles? Sending a SWAT team over a month after the fact to arrest someone for a “he said / she said” traffic altercation scenario seems highly unlikely. Not saying the woman is lying (and I’m sorry she had to go through that), but there has to be more to the story.
The moral of the story is to call 911 immediately after any defensive situation where the gun comes out to advise you have been the victim of a crime and to send police / arrange a place to meet police. Then call U.S. Law Shield, and NEVER give any statement without the advice / presence of a lawyer.
What city was this in? Makes me think of a recent void dire I sat in. 3rd failed attempt to empanel a jury on a murder case that sounded like a clear “knife to a gun fight”.

I am curious to know why the law went after her in such a manner? What did the other person report? Goes to show you she should have called and reported the incident as soon as it occurred and or during the occurrence.

What happened to Innocent until proven guilty! There is no logic to this arrest. I thought police can read people better than anyone else, yet they treated her like a common criminal.
To me, it seems this young girl was connected to someone who could make this happen. I would be suing the PD, the girl, and with some investigation, whoever else was involved in this travesty.
My understanding is that this lady pulled her gun out of her purse, but before the other person got close to the car, drove away, never showing it to the perpetrator, so the gun wasn’t actually used, or seen. How does it become an issue for U.S. Law Shield to defend?
While definitely an endorsement of Texas Law Shield, this is also a cautionary tale about the “he said, she said” nature of police reaction to a report. Likely the SWAT team intervention was the result of a felony warrant being issued (based on the report that her firearm was discharged, at the very least). My advice is to install a continuously recording dashboard camera in your vehicle. That alone would have short-circuited this right at the beginning. They are cheap and the footage will be invaluable in cases like this.
This stuff needs to stop and it needs to be brought to the attention of our senators and congressmen. More and more we’re hearing of cases of enraged drivers causing accidents or nearly causing because of their aggression and then calling in and filing false reports on innocent motorists. Law enforcement officers don’t seem to have a clue that this is happening with the increasing frequency that it is. There needs to be severe repercussions for people who file a false police report against an innocent motorists just because that motorist had to blow the horn for running a red light or stop sign. There is no way I could sleep until I had dragged everyone involved in this false arrest into a civil court and sued them for everything they own and everything their grandkids will ever own.
1) Be the first to call 911.
2) Get description of perps vehicle, license plate, physical appearance.
3) Take photos with cell phone.
4) Call Texas Law Shield.
5) Go to police station, file report with all this information.
This is exactly why you need to be the first person to report the incident to the police.
My CC Instructor harped on covering you ass by calling 911 as soon as any kind of altercation happens when carrying.
Something is missing in this story for sure but it does serve as a good reminder to have and/or continue your law shield membership.
As a retired Law Enforcement Officer I must say that at BEST this case was handled very, very strangely. It almost seems unrealistic. If this were in my jurisdiction all involved parties would have been interviewed thoroughly and the interview would have been video taped. If deception was suspected polygraphs would most likely be offered. It would NEVER be handled the way she describes. NEVER. i have my doubts about this story. Sorry.
Wow! After watching the video my suggestion would be to call 911 immediately. That way you might get an officer out there to interview both parties and document what happened.
There are several things about this video that doesn’t make any sense. I would love to see the original police report.
All the cops had to do was run a background check and they would have realized the person who filed the report filed a false police report which is illegal! And she could get them for false arrest! Shame on the cops!
As a criminal Justice student….and legal beagle of law, what she went through is grounds for a lawsuit when they catch the other person, as well as the police and swat team!!! AND I WOULD PRESS CHARGES! IT sounds to me like she ran across a dope dealer, or an illegal who has an illegal license or no license, insurance and looking for a scam to make money!
the person who accused her needs to be in jail! Running a red light or stop sign is illegal and it is not illegal to give someone the bird or yell profanities! Obliviously who ever accused her does not know American law!
Is Texas or US Law Shield ever going to answer any of these questions? Without answers, I don’t know what or who to believe.
